AV-TEST GmbH (hereafter "AV-TEST") takes the privacy of personal data very seriously and observes the relevant legal provisions concerning data privacy, particularly the provisions provided in the Telemedia Act [Telemediengesetz, (TMG)] and the German Federal Data Protection Act [Bundesdatenschutzgesetz, (BDSG)]. The following serves to inform you about when and which data we are storing within the framework of using our website www.av-test.org and how we are using them.
1. Collection, processing and using personal data
Personal data are only collected by us, if you disclose them to us voluntarily.
1.1 Contact form
If you are contacting us via the contact form supplied on our website, the requested contact information (name, e-mail address) is collected, processed and used exclusively for purposes of processing your inquiry.
1.2 E-Mail Newsletter
If you have applied for our e-mail newsletter on our website, the requested contact information (e-mail address) will only be used for sending the e-mail newsletter. If you subscribe to the e-mail newsletter by way of the apply-button, you will at first receive an e-mail from us. In order to exclude data abuse, the delivery of the e-mail newsletter will only be activated if you have confirmed our e-mail. Your consent regarding the subscription to the e-mail newsletter can be revoked by you at any time. The revocation can be effected by a link in the newsletter itself, directly by way of this link or by message to the contact data below (see item 8 of our data protection declaration).
1.3 Transfer of personal data
If personal data are transferred, then we transfer them exclusively to service providers who are supporting us in the attainment of the aforementioned purposes (e.g. for the dispatch of our e-mail newsletter). Those companies may use your personal data in their capacity as so-called contract data processors only for the execution of the tasks we commissioned them with and they are obliged to observe the relevant data privacy provisions.
Occasionally we may be obliged to disclose your data to the relevant authorities due to legal provisions or legal transactions. There is no further transfer of personal data to third parties.
Processing of your stored personal data takes place exclusively in countries of the European Economic Area.
2. Application of cookies
In order to render visits to our website attractive and in order to enable usage of certain features we are using "Cookies". These are small pieces of text information which are deposited on your terminal via your browser. Reference to specific persons via the cookies used by us is not possible. After the end of your browser session most of the cookies used by us are deleted from your terminal (so-called "session-cookies"). In contrast the so-called "persistent cookies" remain on your computer and enable us to recognize you when you visit our website the next time. Persistent cookies are used by us in particular in connection with the web analysis (see item 3 of our data protection declaration).
Most browsers are configured in such a way, that they accept cookies automatically. You can, however, avoid cookies being stored on your computer by choosing the appropriate browser settings, which may however result in limiting the scope of features on our website.
3. Anonymous collection and evaluation of access data, web analysis
When visiting our website data concerning the relevant access without any references to persons are collected and stored, e.g. type of browser, date and time of access (so-called log-files).
The webserver does not record any complete IP-addresses. Some of these anonymised access data are used for purposes of rectifying faults and of optimising the website as well as for counting the number of visitors. No personal data are processed at that time.
3.2 Using web analysis tools
Our website uses the web analysis tools "Google Analytics" and "Webalizer". Analysing user behaviour is important as by doing so the demand for contents can be analysed and the online offer optimised.
3.2.1 Using Google Analytics
This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In case of activation of the IP anonymization, Google will truncate/anonymize the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. On behalf of the website provider Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to the website provider. According to Google, Google will not associate your IP address with any other data held by Google. AV-TEST does not have any impact on the data collection by Google.
Please note that on this website, Google Analytics code is supplemented by "ga('set', 'anonymizeIp', true);" to ensure an anonymized collection of IP addresses (so called IP masking).
3.2.2 Using Webalizer
The version of "Webalizer" used by us works with anonymised IP-addresses. Prior to possible usage for analysis of user behaviour the IP-addresses are shortened by the last three digits which means that no more reference to persons can be made and you will remain anonymous to us. The anonymised data will be stored on our webserver and exclusively evaluated for internal statistical purposes. A transfer of these data to third parties will not take place at any time.
3.2.3 Right of objection according to Article 15 Section 3 TMG
According to Article 15 Section 3 TMG you have the right of objection against the method of processing data by means of web analysis tools described above (i. e. against generating pseudonymous user profiles). You can prevent analysis of user behaviour by blocking the insertion of cookies by our website in your browser, i. e. by creating an exception in your browser. In order to enforce your right of objection you can also contact us directly (please see below contact information).
4. Your right to information, correction and deletion of personal data
According to the provisions of BDSG you have the right to request information free of charge concerning which of your data have been recorded and for what purpose the recording has been effected. Furthermore you can, as the case may be, demand correction, blocking or deletion of your data. In order to enforce the above rights please contact us directly (see below contact information).

6.1 Social Plugins
Our internet presence under www.av-test.org is complemented through official presences of AV-TEST in the following social networks:

Visitors to our website have the possibility to reach these online sites via references (links). Within the framework of our internet presence those links are indicated by the logos of Facebook, Google or Twitter.
To the extent we use social plugins of the aforementioned social networks in this connection, we resort to the data protection friendly Shariff-solution (see http:www.heise.de/ct/artikel/Shariff-Social-Media-Buttons-mit-Datenschutz-2467514.html).
The customary social-media-buttons already transfer user data to the corresponding social networks upon every access. They establish an unnoticed contact to the servers of the social networks, even if the user is not logged in or is not a member of the network.
The Shariff-solution here acts as an interim entity and takes care that by merely accessing our website in a first step no data are transferred to the social networks. Only if you click on one of the Social Plugins, the data can be transferred to the respective network and be stored there. The social network then will receive the information that you accessed the corresponding sub-page of our online services. For this you do not need an account with a social network nor do you have to be logged in. If you are logged on to the respective social network via your personal user account, the respective social network can link the visit to this website with your user account. In order to avoid this, you have to log out from your user account with the respective social network before clicking the aforementioned Social Plugins.

6.2 Integration of YouTube Videos
For the integration of videos we use the provider YouTube on our website. YouTube is a service of Google Inc. located in 901 Cherry Avenue, San Bruno, CA 94066, USA.
We use integrated YouTube videos in the so-called extended data protection mode, i.e. YouTube does not store any information regarding the user of our website, unless the users watch the video. In case the YouTube video is clicked on, this may trigger further data processing steps (for e.g. the storage of cookies by YouTube), on which AV-TEST does not have any influence.
